1. About us and this policy
Wet Leopard Pty Ltd (“Wet Leopard“, “we“, “us” or “our“) is an Australian company that designs and sells women’s sun protection swimwear, including UPF50+ swimwear, long sleeve rash guards, and underwire swimwear with built-in bust support. We sell through our website at wetleopard.com (the “Site“).
We respect your privacy and are committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights you have. It applies to everyone who visits our Site or buys from us, wherever you live.
By using our Site or providing us with your personal information, you confirm you’ve had the chance to read this policy. If anything here isn’t clear, please contact us — details are at the end.
2. Information we collect
We only collect information we actually need to run our business and serve you well. Depending on how you interact with us, this may include:
Information you give us:
- Name
- Email address
- Phone or mobile number
- Shipping and billing address
- Order and purchase history (products bought, order value, returns and exchanges)
- Information you provide when you contact us, create an account, leave a review, or respond to a survey
Information we collect automatically when you use the Site:
- Website usage data — pages viewed, links clicked, time on site, and how you arrived at our Site
- Device and technical data — IP address, browser type, and device type
- Cookies and analytics data — see Section 9 below
Payment information: When you pay, your card and payment details are collected and processed directly by our third-party payment provider, eWAY. We do not see or store your full card number.
We generally do not collect sensitive information (such as health or biometric data). Please don’t send us sensitive information unless we specifically ask for it.
3. How we use your information
We use your personal information to:
- Process and fulfil your orders — take payment, arrange shipping, and manage returns, exchanges and refunds
- Provide customer service — answer your questions, handle issues, and keep you updated about your order
- Send marketing communications — including email marketing and SMS marketing, where you’ve given us consent (see Sections 4 and 5)
- Improve your experience — understand how our Site is used, fix problems, and make our products, sizing guidance and Site better
- Run our business — keep records, prevent fraud, and meet our legal and tax obligations
We rely on your consent for direct marketing, and we rely on the ordinary needs of our customer relationship (and our legal obligations) for the rest. Where the law requires a specific legal basis, we’ll use the appropriate one.
4. Email marketing consent
If you give us your email address and opt in, we may send you news, offers, product launches and other updates about Wet Leopard. We only send marketing emails to people who have agreed to receive them.
You can unsubscribe at any time using the “unsubscribe” link in any marketing email, or by contacting us at hello@wetleopard.com. We manage our email marketing through Klaviyo (see Section 6).
5. SMS marketing consent and compliance
We use Klaviyo to send SMS (text message) marketing. Our full SMS terms are set out in our Terms & Conditions, but in summary:
- Explicit opt-in required. We only send you marketing texts if you have expressly opted in — for example, by entering your mobile number and agreeing to receive texts at checkout, on a sign-up form, or by texting us to join.
- Message frequency varies. The number of messages you receive will depend on our promotions and campaigns.
- Message and data rates may apply, depending on your mobile carrier and plan.
- Reply STOP to any message to unsubscribe at any time.
- Reply HELP for assistance, or contact us at hello@wetleopard.com.
- Consent is not a condition of purchase. You never have to agree to marketing texts in order to buy from us.
Abandoned cart reminders. Our website uses cookies and similar technologies to keep track of items you add to your shopping cart, including when a cart has been abandoned. Where you have opted in, we use this information to determine when to send you cart reminder messages by email and/or text message (SMS).
We use the mobile number you provide only to send the SMS messages you have signed up for, to respond to your replies, and to send cart reminders where you have opted in.
We do not sell or share your mobile number with third parties for their own marketing.
6. Who we share your information with
We do not sell or rent your personal information. We share it only with trusted service providers who help us run our business, and only as far as they need it to do their job. These include:
- WooCommerce / our website and hosting providers — to operate the Site and manage orders
- eWAY — to process payments securely
- Shipping and fulfilment providers — to pack and deliver your order and process returns
- Klaviyo — to send email and SMS marketing and manage subscriber lists
- Website analytics providers (such as Google Analytics) — to understand how the Site is used
- Professional advisers and authorities — such as our accountants or lawyers, or where we’re required by law
We require these providers to protect your information and to use it only for the services they provide to us. Some of these providers operate under their own privacy policies.
We may also disclose your information where the law requires or permits it, to protect our rights or someone’s safety, or if our business is sold or merged (in which case your information may transfer to the new owner so your relationship with the business can continue).
The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties for their own marketing purposes.
7. International data transfers
We’re based in Australia and sell to customers in Australia, the United States, and internationally. Some of our service providers (including Klaviyo and our analytics providers) store or process data outside Australia, including in the United States.
Where your information is transferred overseas, we take reasonable steps to ensure it’s handled consistently with this policy and applicable privacy laws. By using our Site and providing your information, you acknowledge that it may be processed in countries whose data protection laws may differ from those in your own country.
8. Data security
We take reasonable steps to protect your personal information from misuse, loss, and unauthorised access, modification or disclosure, and to keep it accurate and up to date. Payments are processed through eWAY’s secure, encrypted payment gateway, and we do not store your full card details.
However, no method of transmitting or storing data over the internet is completely secure. While we work hard to protect your information, we can’t guarantee absolute security, and any transmission is at your own risk.
9. Cookies and tracking technologies
Our Site uses cookies and similar technologies to make the Site work, remember your preferences, keep items in your cart (including detecting abandoned carts, as described in Section 5), understand how the Site is used, and support marketing. Some cookies are essential; others are for analytics and advertising.
Most browsers let you control or disable cookies through their settings. If you disable some cookies, parts of the Site may not work as well. Where required, we’ll ask for your consent to non-essential cookies through a cookie banner on the Site.
10. Your privacy rights
Australian customers (Privacy Act 1988 (Cth))
You have the right to:
- Access the personal information we hold about you
- Correct information that’s inaccurate, out of date or incomplete
- Complain if you believe we’ve breached the Australian Privacy Principles
To make a request, email us at hello@wetleopard.com. We’ll respond within a reasonable time. In limited circumstances the Privacy Act allows us to decline a request, and if we do, we’ll explain why. If you’re not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
United States customers
Depending on the state you live in (for example, California, Virginia, Colorado and others), you may have rights to:
- Know what personal information we collect and how we use it
- Request access to or deletion of your personal information
- Opt out of certain sharing of your information for targeted advertising
- Not be discriminated against for exercising your rights
We do not sell your personal information for money. To exercise any of these rights, email us at hello@wetleopard.com and tell us which state you live in. We may need to verify your identity before acting on your request.
